DUI Cases

In Ohio, the current basis for DUI charges is a blood alcohol concentration (BAC) that is .08 or higher. However, a policeman must show probable cause to pull a driver over and order BAC testing. Attorney James Douglass’ past experience as the lawyer for the Cleveland Police Patrolman’s Association allowed him to acquire an in-depth knowledge and understanding of police procedure. He knows first-hand the legal guidelines on administering BAC tests, the regulations regarding calibration of chemical testing devices and whether a test was properly administered.

DUI laws are stiff in Ohio. Immediate surrender of driver’s license and suspension of driving privileges occurs on the spot if you are arrested for a DUI. If you have previous DUI convictions, your license may be suspended for up to 5 years. Felony DUI charges may result in license suspension for life. These penalties only address the administrative aspect of a DUI. DUIs are criminal charges with penalties for conviction that vary depending on repeated offenses. Penalties range from $250 to $10,000 fines and jail or prison time ranging from 3 consecutive days to five years (first to fourth offense comparison of penalties.)
